Terms of Service

These Terms of Service ("Terms") are an agreement between you and Flora Carbon AI ("we," "us"), a company based in Kolkata, India. They apply to our websites and applications: Carbon OS (os.floracarbon.ai), FloraScope (scope.floracarbon.ai), the FloraCarbon calculator (calculator.floracarbon.ai), FloraTrace (the Google Play app ai.floracarbon.floratrace and the dashboard at trace.floracarbon.ai), Carbon Intel (floragpt.floracarbon.ai), Carbon Compass (compass.floracarbon.ai) and floracarbon.ai (together, the "Services").

By creating an account or using the Services you agree to these Terms and to our Privacy Policy. If you use the Services for an organisation, you confirm you have authority to bind it. If you do not agree, do not use the Services.

You must be at least 18 and able to enter into a contract. You sign in with an email code or with Google. Keep your sign-in methods secure and tell us promptly if you think someone has accessed your account without permission. You are responsible for activity under your account and for the people you invite to your projects.

Give accurate information and keep it current. An account is for one person and should not be shared.

You agree not to:

• break the law or infringe anyone's rights;
• upload data you have no right to use, or boundaries or field data you know to be false;
• try to reach other customers' data, or probe, disrupt or overload the Services;
• reverse engineer the Services, scrape them at scale, or use them to build a competing product;
• present outputs as something they are not (see section 5).

We may remove content or restrict access where these rules are broken.

You own your project data. Boundaries, field measurements, photos, documents and other content you put into the Services remain yours (or your organisation's). You give us a limited licence to host, process, analyse and display it, and to share it as you direct, only so that we can provide and secure the Services and as described in the Privacy Policy.

Some records may be anchored by writing only a cryptographic fingerprint (hash) to a public blockchain, as explained in the Privacy Policy. Such fingerprints cannot be removed from the chain. We may use data that has been aggregated and cannot identify you or your project to improve the Services.

Screening verdicts, land-eligibility results, carbon estimates, calculator results and assistant answers are indicative. They help you plan and prepare. They are not registry approvals, verification or validation statements, or legal, tax, investment or financial advice, and they are not a promise that a project will be registered or that credits will be issued or sold.

Final eligibility and issuance are decided by the relevant carbon standard, registry or scheme and its validation and verification body (VVB). Check important results independently. The AI assistant can make mistakes.

The Services depend on third parties, including authentication, hosting, email, satellite data and AI providers, and refer to external standards, methodologies and registries that we do not control. Those parties' own terms apply to their services, and their rules can change. We are not responsible for third parties' acts or availability, or for changes to a standard that affect your project.

We and our licensors own the Services, including software, models, designs, text and trademarks (such as Flora Carbon, Carbon OS, FloraScope, FloraTrace, Carbon Intel and Carbon Compass). We give you a limited, non-exclusive, non-transferable right to use the Services for your own business purposes while these Terms apply. Nothing here transfers our intellectual property to you. If you send us feedback, we may use it without obligation to you.

Some features are free. Others are paid, stage-based access. Where you buy paid access, the price and scope are quoted to you separately and agreed before you are charged, and taxes are extra unless stated. Unless we agree otherwise in writing, fees already paid are not refundable except where the law requires.

You can stop using the Services and delete your account at any time (see delete account). We may suspend or end access if you breach these Terms, create risk or legal exposure for us or others, or do not pay for paid access, or if we stop offering a Service; where reasonable we will give notice. Sections that by nature should survive (ownership, disclaimers, liability, governing law) continue after termination. On termination we handle your data as set out in the Privacy Policy.

The Services are provided "as is" and "as available". To the extent the law allows, we do not promise that the Services will be uninterrupted, error-free or secure, or that outputs, satellite data or estimates will be accurate, complete or fit for a particular purpose.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profit, revenue, credits or opportunity, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the fees you paid us for the Services in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

These Terms are governed by the laws of India. The courts at Kolkata, West Bengal have exclusive jurisdiction over disputes arising from them, subject to any mandatory rights you have under applicable law.

We may update these Terms. We will post the new version at this address and change the "Last updated" date; for material changes we may also notify you in the Services or by email. Continuing to use the Services after a change means you accept it.
